13.1 — Permitted Automation:

• Private Telegram Integrations: Internal server-side event notifications not exposed via any public-facing URL.
• Low-Resource Backend Scripts: Scheduled automation scripts that operate within allocated CPU and memory thresholds.

13.2 — Prohibited Automation & Bot Hosting:

• Publicly Accessible Bot Panels: PHP-based bot control dashboards or management interfaces accessible via a public URL.
• Automation-Based Public Websites: Web applications whose primary function is managing bot interactions at scale.
• Public Bot Dashboards: Any platform enabling third parties to interact with or configure automated scripts.
• High-Resource Automation: Any automation generating disproportionate CPU, memory, or network traffic beyond plan allowances.

13.3 — Consequences of Non-Compliance:

• Automated flagging and internal compliance review.
• Suspension without prior notice to protect shared infrastructure.
• Technical review prior to any reactivation consideration.
• Permanent account termination for repeated or wilful violations.

Terms and Conditions

1. Acceptance of Terms

These Terms and Conditions constitute a legally binding contract between Aryanispe Host (operated by Aryan Gupta, Entrepreneur, founded September 11, 2025) and any individual, company, or legal entity that accesses the Website or utilizes the Services. By registering, purchasing, or using the Website, the User irrevocably acknowledges having read, understood, and unconditionally agreed to all provisions herein. Aryanispe Host reserves the right to decline or cancel any account.

2. Eligibility & Account Registration

• The User must be a minimum of 18 years of age and legally capable of forming a binding contract under Indian law.
• The User must provide complete, accurate, and truthful registration information. Submitting false data constitutes a material breach and may result in immediate account termination.
• Account credentials are the sole responsibility of the User. The User is fully liable for all activities conducted under their account.
• Users must maintain a valid, active email address at all times. Critical communications are delivered exclusively to the registered email.
• Any suspected unauthorized use must be reported immediately to [email protected] or WhatsApp +91 97713 48544.
• If we detect suspicious registration or ordering activity, the User may be requested to complete a verification process (such as phone, email, or basic identification validation). Failure or refusal to complete this verification within the requested timeframe will result in immediate account suspension and termination with zero refund eligibility.
• Aryanispe Host reserves the right to decline any registration or cancel any account at its sole discretion.

3. Service Provision & Rights Reserved

Aryanispe Host agrees to provide the Services selected and paid for by the User, subject to receipt of full payment and availability of technical infrastructure. All rights not expressly granted to the User are reserved, including the right to modify, suspend, or discontinue any Service at any time; impose or modify resource limits; and migrate accounts between servers or data centers as required.

4. Payment, Billing & Renewal Terms

All charges are due in advance per the billing cycle selected at purchase. Services auto-renew unless cancelled prior to the renewal date. Pricing may be modified with reasonable notice; continued use constitutes acceptance. All transactions are processed in INR unless stated otherwise.

• Accepted Payment Gateways: For Indian clients, payments are processed securely via trusted gateways Razorpay and Cashfree (supporting UPI, Netbanking, and Cards). For International clients, we accept payments securely via Cryptomus (supporting Cryptocurrency and Binance Pay).
• Pre-Order Checking: It is the sole responsibility of the User to double-check and verify all order inputs (including domain spellings, hostnames, administrative email address, and configurations) before checkout. Aryanispe Host holds no liability for configuration issues or wrong domain registrations arising from user input.

5. Service Continuity & Data Management

• It is the sole responsibility of the User to ensure invoices are paid before their due date to maintain uninterrupted service. Unpaid services are suspended immediately on the due date.
• Shared, Cloud, WordPress, Reseller, and Master/Alpha Reseller Hosting Accounts: If unpaid, these hosting services are permanently terminated and deleted from our servers 20 days after the due date. All data, files, and backups associated with the account will be permanently erased.
• Virtual Private Servers (VPS) & Virtual Dedicated Servers (VDS): If unpaid, VPS and VDS services are permanently terminated and deleted 5 days after the due date / suspension. No backups of VPS/VDS data are retained after termination.
• Backups & JetBackup: For Shared, Cloud, WordPress, Reseller, and Master/Alpha Reseller hosting, we maintain a rolling backup of the last 7 days on our servers. Users can easily view, download, or restore their backups at any time via the JetBackup tool in cPanel. However, Aryanispe Host holds no liability for data loss or backup failures, and the User ultimately bears full responsibility for maintaining off-server backups.
• To reactivate after termination, the User must purchase an entirely new plan, subject to hardware availability, and restore data from their own backups.

6. Suspension & Termination by Aryanispe Host

Aryanispe Host reserves the right to immediately suspend or permanently terminate a User's account without prior notice under any of these conditions:

• Non-payment of any fees on or before the due date.
• Breach of any provision of these Terms, the Privacy Policy, or the Acceptable Use Policy.
• Engagement in any activity illegal under Indian or international law.
• Any action that threatens the security, integrity, or performance of Aryanispe Host's infrastructure.
• Receipt of a binding court order, government directive, or law enforcement request.
• Discovery that the User provided false, fraudulent, or materially misleading information.
• Opening a payment dispute, chargeback, or claim on payment gateways (such as Razorpay, Cashfree, etc.) without contacting our support team first. This will result in immediate, permanent termination of all active services without refund, and the user's details will be reported to global hosting fraud databases.
• Engagement in any disrespectful, abusive, threatening, or rude behavior, language, or communication toward any member of the Aryanispe Host support staff. This will result in immediate, permanent termination of all active services with zero refund eligibility.

7. Acceptable Use Policy & Suspension

The following are strictly prohibited. Violation of these services or abuse of any kind will lead to direct account suspension and termination without prior notice, and will automatically void any refund eligibility:

• Hosting, distributing, or facilitating access to pornographic material, adult content, CSAM, obscene content, or material inciting violence, terrorism, or discrimination.
• Infringing upon any third-party intellectual property rights.
• Sending spam, conducting phishing campaigns, distributing malware, or facilitating email bombing.
• Launching or facilitating DoS/DDoS attacks or any unauthorized network intrusion.
• Deploying cryptocurrency mining scripts, unauthorized proxy/VPN services, or TOR exit nodes.
• Attempting unauthorized access to any account, server, database, or network.
• Hosting or distributing malware, ransomware, spyware, viruses, botnets, or any malicious software.
• Operating illegal services, fraudulent e-commerce stores, or any activity violating Indian consumer protection laws.
• Hosting or facilitating gambling/betting platforms, unauthorized trading systems, banking fraud, financial scams, phishing pages, or sending spam. Any such prohibited activity will lead to immediate account termination and domain suspension without prior notice, with zero refund.

8. Intellectual Property Rights

All content, software, source code, databases, APIs, user interfaces, graphics, trademarks, and proprietary materials displayed on the Website are the exclusive property of Aryanispe Host or its respective licensors, protected under Indian and international intellectual property law including the Copyright Act, 1957 and Trade Marks Act, 1999. The User is granted no right to reproduce, modify, distribute, or create derivative works without prior written authorization.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS. ARYANISPE HOST EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARYANISPE HOST, ITS FOUNDER ARYAN GUPTA, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND.

The maximum aggregate liability for any claim shall not exceed the total amount paid by the User to Aryanispe Host during the twelve (12) calendar months immediately preceding the event giving rise to the claim.

11. Indemnification

The User agrees to indemnify, defend, and hold harmless Aryanispe Host, its founder Aryan Gupta, officers, directors, employees, contractors, agents, and assigns from any and all third-party claims, liabilities, damages, judgments, costs, and legal expenses arising from the User's use of the Services; breach of these Terms; infringement of any third-party intellectual property or privacy right; content uploaded through the User's hosting account; or any violation of applicable law.

12. Governing Law & Dispute Resolution

These Terms shall be governed by the substantive laws of the Republic of India. Disputes shall be resolved sequentially through:

1. Good-Faith Negotiation: Both parties will make a genuine effort to resolve the matter directly within thirty (30) days of written notification.
2. Formal Legal Proceedings: If negotiation fails within 30 days, both parties consent to the exclusive jurisdiction of competent civil courts in India.

13. Modification of Terms

Aryanispe Host reserves the right to change, modify, add, or remove any provision of these Terms at any time. All modifications take effect immediately upon publication on the Website. Continued use of the Services following any modification constitutes the User's acceptance of the revised Terms.

14. reCAPTCHA Security & Data Processing

We have implemented reCAPTCHA v3 on our site to prevent spam and automated abuse. Your use of reCAPTCHA v3 is subject to the Google Privacy Policy and Google Terms of Service.

reCAPTCHA works by collecting hardware and software information, such as device and application data, and sending these data to Google for analysis. The information collected will be used for improving reCAPTCHA and for general security purposes; it will not be used for personalized advertising by Google.

15. VPS & VDS Service Policy

• Unmanaged Support Limits: All Virtual Private Servers (VPS) and Virtual Dedicated Servers (VDS) are unmanaged. The support team is responsible only for server hardware, network virtualization, and control panel availability. Configuration of DNS, email servers, custom applications, and OS administration is the sole responsibility of the User.
• Spam & Port 25 Blocking: Outbound Port 25 (SMTP) is strictly blocked on all VPS and VDS instances to prevent IP blacklisting. Users must utilize third-party SMTP services (such as SendGrid or Mailgun) for transactional and outbound mail delivery.
• IP Block / Target Domain Accessibility: Aryanispe Host does not warrant or guarantee that any external domain or website is accessible from the assigned VPS/VDS IP address. Blocklists on third-party security platforms (such as Cloudflare firewalls) are out of our control and do not qualify for refunds or IP changes.

16. Shared Hosting Resource Limits

• Inode Capping (File Limits): To protect server performance, each cPanel account has a hard limit of 150,000 Inodes (file and directory count). Exceeding this limit will prevent new file creation and may lead to suspension.
• Cron Job Frequency: Scheduled cron entries must not be configured to run at intervals of less than 15 minutes. Any cron running more frequently will be disabled or modified automatically.
• Database Capping: Each individual MySQL database must not exceed 1 GB in size. Exceeding this cap degrades server performance and will result in optimization requests or temporary suspension.
• Prohibited Storage Content: Shared and Reseller hosting plans are designed strictly for website hosting. Storage of personal backups, zip archives, installer packages, raw media storage, torrent files, and PDF/file archiving is strictly prohibited. Hosting movie sites, video streaming portals, or storing large video files violates our hosting storage policy and is subject to immediate suspension.
• Resource Monitoring & Process Termination: For all hosting services (excluding VPS and VDS which have dedicated/isolated resources), we actively monitor CPU, I/O, RAM, and entry processes. If we detect that a user's processes or logs are causing excessive server load or degrading server performance for other users, we reserve the right to immediately terminate/kill the offending processes, clear large log files, or temporarily suspend the account without prior notice to maintain server stability.
